Terms of service.

1. The agreement

These Terms of Service (the “Terms”) form an agreement between you and Motofolio (“Motofolio,” “we,” “us”) covering your use of the Motofolio website, apps, and services (the “Service”). By creating an account or using the Service you accept these Terms. If you don't agree, don't use the Service.

2. Your account

You need an account to use most of the Service. You must be at least 16 years old, or older if your local law sets a higher age for processing personal data without parental consent.

• Keep your sign-in details private. You're responsible for activity that happens through your account.
• One person per account. You can run multiple garages from one account, but accounts are not transferable to another person.
• Tell us promptly at security@motofolio.app if you suspect your account has been compromised.

3. Your content

Photos, descriptions, chassis numbers, timeline entries, and anything else you put into Motofolio are your content. You own it. You're responsible for having the rights to share it.

The licence you give us

To run the Service we need a limited licence. By uploading content you grant Motofolio a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, resize, transcode, back up, and display your content for the purpose of operating and improving the Service. The licence ends when you remove the content or close your account, except for backups kept for a reasonable period and any content other users have already saved or referenced.

Public vs. private content

You choose the visibility of each car: public, unlisted (link-only), or private. Public content can be indexed by search engines and shown on the open web. Private content is visible only to you. Don't put anything in a public garage you wouldn't put on a public website.

Removal

You can delete your content at any time. We can remove or restrict content that breaches these Terms, applicable law, or a third party's rights — we'll tell you why where we reasonably can.

4. Acceptable use

You agree not to:

• Post content that is illegal, defamatory, hateful, harassing, or infringes someone else's rights.
• Impersonate another person, claim ownership of cars you don't own, or misrepresent chassis history.
• Use the Service to facilitate fraud, vehicle cloning, odometer tampering, or evasion of registration or insurance requirements.
• Scrape, mirror, or systematically extract data from other users' garages without their permission.
• Interfere with the Service — probing, reverse engineering, denial of service, or anything that degrades it for other people.
• Upload malware, run ads, or use Motofolio as a host for unrelated content.

5. Chassis data & shared records

Motofolio links cars by chassis number so the record can travel between owners. When you add a chassis number that another user has also added, we may surface that the record is shared — never with the other user's personal details, only that the number is in more than one garage. You can opt your car out of chassis matching in its visibility settings.

Chassis numbers are vehicle identifiers, not personal data on their own. Don't enter someone else's identifying information alongside a chassis number unless you have their consent.

6. Paid plans

The core Service is free. Some features (additional cars, full- resolution exports, advanced storage) may require a paid plan (“Motofolio Plus”). Pricing, included features, and renewal terms are shown at checkout and in your account billing page.

• Plans renew automatically until cancelled. Cancel any time from your account — access continues until the end of the current period.
• Refunds are at our discretion and given on a case-by-case basis. Statutory consumer rights in your country are not affected.
• We may change pricing with at least 30 days' notice; price changes never apply retroactively to a period you've already paid for.

7. Ending the agreement

You can close your account at any time from your settings page. We can suspend or close an account that materially breaches these Terms, creates legal risk, or that has been inactive for more than 24 months — in the last case we'll email you first with a way to keep it open.

When an account closes we delete the content within 30 days, other than backups retained for a reasonable period and anything we're required to keep by law.

8. Warranties & liability

The Service is provided “as is” and “as available.” We don't warrant that it will be uninterrupted or error-free, or that any specific car data, market values, or chassis-history claims are accurate or complete.

To the maximum extent allowed by law, Motofolio's total liability to you for any claim arising out of or relating to these Terms or the Service is limited to the greater of: (a) the amount you paid us in the 12 months before the claim, or (b) £50.

Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.

9. Governing law

These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that if you are a consumer you may bring proceedings in the courts of the country where you live.

10. Changes to these terms

We may update these Terms. If a change is material we'll give you at least 30 days' notice by email and in-app. Continued use after the change takes effect means you accept the new Terms; if you don't, close your account before then.
